Changes in IATA Resolution 600b
"AIR WAYBILL Conditions of Contract"

This is to inform you that the following changes in IATA Resolution 600b "AIR WAYBILL-Conditions of Contract" were adopted at the IATA Cargo Service Conference (CSC) held in Mexico in March 2007.This Resolution was already approved by governments of concerned countries, and is scheduled to be effective from March 17, 2008. In accordance with this Resolution, NCA will amend our Conditions of Contract on Air Waybill from March 17, 2008.

2. Changes


Liability of the Carrier
Concerning Carrier’s limitation of liability, Carrier will treat 250 French gold francs (provided by the Warsaw Convention) as the equivalent conversion of 17SDR unless a greater amount is specified in the Carrier’s condition of carriage. (After March 17, 2008, liability of the Carrier per kilogram for transportation covered by the Warsaw Convention and Montreal Convention will be regarded as 17SDR)


Liability for carriage to which no Convention applies
For carriage to which neither the Warsaw Convention nor the Montreal Convention applies, Carrier’s liability limitation shall not be less than (instead of "exceed") the per kilogram monetary limit set out in Carrier’s tariffs or general conditions of carriage for cargo lost, damaged or delayed. In addition, such limitation of liability in an amount less than 17SDR per kilogram will not apply for carriage to or from USA.


Partial Loss
The wording of "partial loss" will be deleted from Article 10.1.1 of Resolution-600b (provides that a cargo complaint must be made within 14 days from the date of receipt of the cargo). Consequently, a partially lost shipment shall be considered as "non-delivery" cargo stipulated in Article 10.1.3. and a cargo claim shall be settled based on Article 10.1.3. (provides that a cargo complaint must be made within 120 days from the date of issue of the air waybill)


Compliance with law and regulations of "through or over" country
Currently Article 11 requests the shipper to comply with all applicable laws and government regulations of any country to, from, through or over which the cargo may be carried. It was agreed at the CSC to delete "through or over" to enable the shipper to comply with the requirements of Article 11 of Resolution-600b. In case "through and over" countries are notified in advance, the shipper shall comply with applicable laws and regulations.


Note at the end of IATA Resolution 600b
"Note: 250 French gold francs is equal to approximately 17 SDR" shown at the end of the Condition of Contract will be deleted.
