        Revision of "Condition of Carriage" and "Conditions of Carriage by Charter Flight"


This is to inform you that NCA revises our “Conditions of Carriage” and “Conditions of Carriage by Charter Flight” in accordance with the amended IATA Resolution 600b "AIR WAYBILL-Conditions of Contract".

1. Effective Date: March 17, 2008

2. Major Points to be Revised
(1) Liability of the Carrier
Concerning Carrier’s limitation of liability, NCA will treat 250 French gold francs (provided by the Warsaw Convention) as the equivalent conversion of 17SDR. For carriage to which neither the Warsaw Convention nor the Montreal Convention applies, NCA sets out its liability limitation as 17SDR per kilogram.
With these provisions, the liability of NCA is unified as 17SDR per kilogram.

(2) Compliance with law and regulations of "through or over" country
The amended AWB Conditions of Contract deleted the wording “through or over” from the countries of which the shippers are required to comply with the laws and regulations. However, in case these countries are notified in advance, the shippers are requested to comply with the laws and regulations.
Therefore, “any country to, from, through or over which the cargo may be carried” in the applicable provisions is revised to “any country to or from which the cargo may be carried, or any country through or over which the cargo is planned to be carried”

(3) Partial Loss
“Partial loss” is deleted from the provision that a cargo claim notice must be presented within 14 days from the date of the receipt of the cargo. However, shortage of inner contents of the cargo is considered as destruction of or damage to the cargo, and this provision is applied.
